A father had total custody of his 4 year old child since his recent separation from the mother. However, without any agreement between the parties, the mother went to pick up the child at the daycare centre and refused to let the father see his son. She also lodged a complaint to the Director of Youth Protection, alledging that the father had sexually abused his son.
Therefore the father came to meet Mrs. Veronica Vallelonga at our offices and a court order was introduced in the Montreal district Superior Court to establish legal custody. Our family lawyer subpoenaed the representative of the DYP to have her testify in Court. The social worker confirmed that the complaint for sexual abuse was not founded according to the investigation carried out by the Director of Youth Protection. Mrs. Vallelonga explained to the Court that her client feared for the safety of the child when it was with the mother.
For this reason, the Superior Court provisionally granted exclusive custody of the child to its father as well as supervised visiting rights for the mother.
