Sometimes the legal father and the biological father are two separate people. The biological father has a genetic link to the child and helped conceive it. The legal father is the person acting as the parent since the child’s birth. The child bears that parent’s name.
Consequently, the biological father (if different from the legal father) is entitled to contest the filiation of another man with that child within a given time frame. That’s what our client’s request was all about.
This time around, the blood relationship prevailed.
