A couple who had a child had made a verbal agreement concerning the shared custody of their child. One of the parties decided to withdraw the child from its daycare without the consent of our client and refused to grant her visiting rights. Our family lawyer submitted an urgent request with a 48 hour appearance deadline to re-establish her client’s visiting rights.
This case was pleaded at the Palais de justice of Montreal by means of a detailed affidavit as evidence. Mrs Vallelonga allegated the urgency of the situation. The defendant objected to this request and wanted rather to have exclusive custody of the child with visiting rights. The Judge finally decided that shared custody had to be reinstated at the interim stage.
