A Laval person had various personal problems, which meant his child was placed in his sister’s custody. The DYP used its discretionary power to withdraw the child from this family environment under the pretext that various Court orders had not been followed. The parents did not know the whereabouts of the child. Therefore, they met with our family lawyer to get help with this situation.
Our lawyer’s partner immediately went to Court. The DYP wanted to continue placing the child in a foster home until the trial and that contact between the parents and their child be supervised. Our lawyer requested that the child could move back home. He cross-examined the social worker testifying for the DYP in order to prove he was neglectful in keeping the parents informed about various Court orders. He also had a member of the family testify.
The Judge finally ordered that the child might return to its family at least until the trial.
