This was a case in which our client, represented by lawyer Vivan Nguyen, lovingly accompanied their daughter during a hospital stay. The DYP tried having our client declared negligent under article 38b) of the Youth Protection Act—grounds that were rejected by the judge at trial!
Unfortunately, it often happens that a good parent needs to defend themselves in court against the DYP, when all they were doing was supporting their child through difficult moments, such as behavioural issues, mood swings or anxiety disorders.
The judge clearly stated that a child in distress does not mean a neglectful parent!
