Laurie Fournier, a family law attorney at Devichy Lawyers, successfully represented a father in a petition to modify custody arrangements concerning his two children.
In this case, the Court had to decide a delicate issue: should the clearly expressed wish of the older child to live with his father take precedence, or should priority be given to the particular needs of the younger child, who required specialized services available at his current school?
After reviewing the evidence, including reports from the children’s appointed counsel, the judge concluded that both children should remain together and that their best interests warranted an immediate move to their father’s home.
The Court was also satisfied that the neighborhood school could meet the younger child’s specific needs, particularly in terms of speech therapy and educational support.
The judgment, issued just days before the start of the school year, therefore granted the father sole custody and authorized the enrollment of the children in their new school. The mother retains access rights.
