In this case before the Quebec Court, Devichy Lawyers (represented by Lawyer Émilie Houle) acted on behalf of the mother, who has a mild intellectual disability. This aspect was consistently used by the Director of Youth Protection to argue for a majority placement of the child, despite a significant improvement in the mother’s parenting abilities.
Indeed, all parties involved in the case acknowledged the parents’ progress. The Court was reassured by the parents’ testimony and their willingness to seek support when needed, in the best interest of their child. As a result, a gradual return of the child to their parents was authorized, and the supervision of contacts was lifted.
