One parent must receive the permission of the other parent to travel alone with their minor children outside Canada (to the United States or elsewhere). This authorization to travel is granted in writing on a form containing all relevant data about the parents and the children, as well as the time and place of travel. Therefore this form has to be signed by the parent who is not traveling and is subject to an oath.
In case the remaining parent refuses to consent permission to travel, the family lawyer may submit an urgent request to the Superior Court to obtain the court’s authorization. The court must consider the motives of both parents and especially, the children’s best interests.
