Our team obtained a favorable safeguard order before the Superior Court in the district of Québec. Represented by Me Ariane Gendron, our client—a mother of two young children—was seeking sole custody, child support, and the termination of co-ownership of the family home.
The Court considered the young age of the children, their fragile health, and allegations of violence, in accordance with article 33 of the Civil Code of Québec. Sole custody and exclusive use of the family residence were granted to the mother. The father was awarded visitation rights every other weekend.
Child support was set and reduced by 20% to reflect father’s responsibility for certain housing expenses. The father is required to continue covering the shared household costs (mortgage, taxes, insurance).
This order is valid for six months or until a final judgment is rendered.
