In this complex case, the plaintiff sought to modify previously established shared custody arrangements, wishing for the child to start kindergarten in her city of residence, City A. However, the child was already enrolled in the school in City B, where Élizabeth’s client resides.
Élizabeth successfully argued in favor of the child’s best interests, demonstrating that the child’s stability and well-being would be better ensured by maintaining their enrollment in the school in City B. The Tribunal recognized that this city represented the child’s anchor point and that the school proposed by the defendant offered a stimulating environment adapted to their needs.
Following Élizabeth’s representations, the Tribunal rejected the plaintiff’s request and granted the defendant majority parental time with the child, while also granting the plaintiff extended parental time. This decision highlights the importance of strong legal representation focused on the child’s best interests.
