In this case, lawyer Ariane Gendron represented the father, who was seeking a revision of the child support to be paid for the benefit of his two adult children. An agreement had been reached between the parties in 2019 but had not been modified since then.
Over the past few years, the father had been attempting to obtain certain relevant documents from the mother, but she had been refusing to cooperate. The Court ruled in favor of the father and thus ordered the retroactive modification of the child support, in addition to ordering the mother to reimburse the father for the overpaid amount, due to her bad faith. Our lawyer also successfully obtained the establishment of a fixed term for the child support, namely until the respective completion of the two children’s studies.
Furthermore, the mother was claiming over $35,000 in provision for expenses, but again, the Court concluded that better cooperation on her part would have allowed her to reduce her attorney fees, resulting in an award of only $3,500.
