{"id":1079,"date":"2025-09-02T22:29:37","date_gmt":"2025-09-02T17:29:37","guid":{"rendered":"https:\/\/csklawyers.ca\/familylaw\/?p=1079"},"modified":"2025-09-02T22:29:38","modified_gmt":"2025-09-02T17:29:38","slug":"custody-change-granted-for-our-client-just-before-the-start-of-the-school-year","status":"publish","type":"post","link":"https:\/\/csklawyers.ca\/familylaw\/custody-change-granted-for-our-client-just-before-the-start-of-the-school-year\/","title":{"rendered":"Custody Change Granted for Our Client Just Before the Start of the School Year"},"content":{"rendered":"\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<p>Laurie Fournier, a family law attorney at Devichy Lawyers, successfully represented a father in a petition to modify custody arrangements concerning his two children.<\/p>\n\n\n\n<p>In this case, the Court had to decide a delicate issue: should the clearly expressed wish of the older child to live with his father take precedence, or should priority be given to the particular needs of the younger child, who required specialized services available at his current school?<\/p>\n\n\n\n<p>After reviewing the evidence, including reports from the children\u2019s appointed counsel, the judge concluded that both children should remain together and that their best interests warranted an <strong>immediate move to their father\u2019s home<\/strong>.<\/p>\n\n\n\n<p>The Court was also satisfied that the neighborhood school could meet the younger child\u2019s specific needs, particularly in terms of speech therapy and educational support.<\/p>\n\n\n\n<p>The judgment, issued just days before the start of the school year, therefore granted the father <strong>sole custody<\/strong> and authorized the enrollment of the children in their new school. The mother retains access rights.<\/p>\n\n\n\n<p>Congratulations to Laurie for this victory, which highlights the importance of protecting the best interests of children in complex family situations.
